Planning Scheme Amendments
As a living document, amendments are made to the Livingstone Planning Scheme 2018 from time to time. The term 'amendments' refers to or involves any changes made to the text of the planning scheme, changes to a planning scheme map or both. To ensure the Livingstone Planning Scheme 2018 is kept up to date and operating effectively, planning scheme amendments are required every so often. The process for amending a planning scheme is set out in the Planning Act 2016 and the Minister's Guidelines and Rules.

Notice is hereby given that the Livingstone Shire Council is commencing the statutory public consultation period for the proposed Package 3 Amendments to the Livingstone Planning Scheme 2018 on 14 September 2020. The public consultation period will end on 16 October 2020.
The Package 3 Amendments are comprised of administrative and minor amendments and a range of major amendments. The purpose of the amendments is to update policy and to assist with planning scheme interpretation and implementation.
The general effect of the amendments will be:
- updated assessment benchmarks that apply to Dwelling Houses and Dual Occupancies;
- amended categories of development, categories of assessment, or amended assessment benchmarks for:
- different building work circumstances;
- clearing native vegetation;
- earthwork and building work where affected by storm tide hazard overlays or flood hazard overlays;
- development where affected by greenbreak overlays;
- amended specific benchmarks for assessment contained in zone codes, local plan codes, and schedules, primarily regarding built form acceptable outcomes for the design and siting of buildings or structures;
- amended specific benchmarks for assessment contained in the Scenic Amenity Overlay Code, Coastal Hazard Overlay Code, and Flood Hazard Overlay Code;
- amended specific benchmarks for assessment contained in the Development Works Code, regarding advertising devices, clearing native vegetation, earthwork and retaining walls;
- amended zones and zone precincts over lots in the following localities: Barmaryee, Byfield, Farnborough, Mount Chalmers, Ogmore, Pacific Heights, Tanby, Taroomball, The Caves, and Yeppoon;
- amended acid sulfate soils overlay maps and scenic amenity overlay maps;
- a new building height limit overlay map;
- amended Schedule 1 Definitions to improve consistency with the Planning Regulation 2017 and to include new administrative terms.
The amendments and supporting material can be inspected by downloading from Council’s internet website: https://www.livingstone.qld.gov.au.
A request to purchase the amendments can be made via telephone by calling (07) 4913 5000 or 1300 790 919, or in-person during Council open hours at the Yeppoon Town Hall (25 Normanby Street), or the Emu Park Library (7 Hill Street).
Any person may make a submission on the proposed amendments during the public consultation period. Submissions can be made:

- by postal service addressed to Livingstone Shire Council, Attention Growth Management, P.O. Box 2292, Yeppoon QLD 4703; or

- state the grounds for the submission, and the facts and circumstances relied on to support the grounds; and
- state one postal or electronic address for services relating to the submission for all submission-makers.

Making a Submission
A submission is a written comment about a proposed planning scheme amendment made by any interested member of the community (for example, person, group or organisation). A submission may support or object to all or part of a proposed planning scheme amendment, or suggest alternative options.
When can a submission be made?
Any person can make a submission during the public consultation period for a proposed amendment. Please view the public notice associated with a proposed amendment to determine the public consultation timeframe.
How to make a submission?
For a submission to be categorised as a properly made submission, the submission must:
- be in writing and, unless the submission is made electronically, be signed by each person (the submission-makers) who made the submission;
- be made to the Chief Executive Officer, Livingstone Shire Council;
- be received during the consultation period;
- state the name and residential or business address of all submission-makers;
- state the ground for submission, and the facts and circumstances relied on to support the grounds; and
- state one (1) postal or electronic address for service relating to the submission for all submission-makers.
Submissions can be made:

Grounds for a submission
It is important that a submission focus on matters directly associated with a proposed amendment. It is also important that the grounds of a submission are supported by facts and circumstances to support the grounds.
Submissions are not confidential
Anonymous submissions will not be considered, and all properly made submissions are published on the Council website for viewing along with the planning scheme amendments.

Following the end of the public consultation, Council must prepare a consultation report about how Council has dealt with every properly made submission. The Final Consultation Report for Package 3 Amendments are now available for viewing.

Council has progressed the Package 3 Amendments through various phases of the statutory process for making amendments to a planning scheme. On 19 January 2021 the Livingstone Shire Council resolved to adopt the Package 3 Amendments to the Livingstone Planning Scheme 2018.

Notice is given under the Planning Act 2016 and the Minister’s Guidelines and Rules, that the public consultation period for Livingstone Shire Council’s proposed Local Government Infrastructure Plan (LGIP) Amendment will begin on Friday 6 June 2025 and will finish on Friday 4 July 2025.
It is a statutory requirement in Queensland that each local government has a Local Government Infrastructure Plan (LGIP). The Livingstone Shire Council has an adopted LGIP (i.e., LGIP Version 1) which forms part of the Livingstone Planning Scheme 2018. The current and amended LGIP apply to the entire local government area of the Livingstone Shire.
A five-yearly review of Council’s LGIP has been completed. The purpose of the LGIP Amendment is to ensure that the plan remains accurate, current and relevant. Council decided at its ordinary meeting on 17 December 2024 to make the LGIP Amendment. A State Government Review stage has been undertaken and Council has been notified that it may progress the LGIP Amendment to Public Consultation. The public consultation phase provides an opportunity for the community to view the amended LGIP and to make a submission.
The general effect of the LGIP Amendment will be an amended planning scheme which includes the following:
- An amended planning scheme Part 4 - Local Government Infrastructure Plan. This amended part of the planning scheme includes amended planning assumptions, an amended Priority Infrastructure Area, amended Desired Standards of Service for trunk infrastructure, and amended Plans for Trunk Infrastructure.
- An amended planning scheme Schedule 3 – Local Government Infrastructure Plan Mapping and Tables. This amended part of the planning scheme includes amended planning assumptions tables, an amended schedule of works, and amended maps.
The proposed LGIP Amendment and supporting information can be viewed online via Council’s website www.livingstone.qld.gov.au and it will be available for inspection or purchase at Council’s Customer Service Centres, located at 25 Normanby Street, Yeppoon, or 7 Hill Street, Emu Park.
Any person may make a submission to the Livingstone Shire Council about the LGIP Amendment. Submissions can be made in writing:
- by electronic mail via the following address: enquiries@livingstone.qld.gov.au; or
- by postal service addressed to Livingstone Shire Council, Attention Growth Management, P.O. Box 2292, Yeppoon, QLD, 4703; or
- by delivery in-person during Council office open hours at the Yeppoon Town Hall (25 Normanby Street), or Emu Park Library (7 Hill Street).

What is a Local Government Infrastructure Plan (LGIP)?
- An LGIP is a part of Council’s planning scheme that identifies shared (trunk) infrastructure to service forecast growth for the next 15 years
Why have an LGIP?
- Helps to coordinate the delivery of infrastructure with land use planning decisions. It does this by providing information about planned trunk infrastructure and its costs
- It helps Council to estimate the cost of its future capital works program for budgeting purposes
- A local government is required to have an LGIP if it wishes to levy infrastructure charges
What are the key components of an LGIP?
- Planning Assumptions: Assumptions made about the expected type, amount, location and timing of urban development.
- Priority Infrastructure Area (PIA): The PIA is the geographic area that Council will prioritise for the provision of trunk infrastructure over the next 15 years. Council must plan trunk infrastructure to service development of the PIA and identify that infrastructure in its LGIP.
- Desired Standards of Service (DSS): The standards that Council will apply to the planning of trunk infrastructure.
- Plans for Trunk Infrastructure (PFTI): Identifies the trunk infrastructure necessary to service existing and future urban development of the PIA.
- Schedule of Works Financial Model (SoW): Provides information about the trunk infrastructure necessary to service existing and future urban development. It includes a project description, estimated timing and cost (including on-costs and contingency).
What networks are included in the current and proposed amended LGIP?
- Current LGIP includes planned networks for:
- Public Parks and Land for Community Facilities,
- water supply
- sewerage
- transport
- stormwater
- Proposed amended LGIP includes planned networks for:
- Public Parks and Land for Community Facilities,
- water supply
- sewerage

- Stormwater network is not included. Stormwater strategy yet to be defined. Stormwater planning not undertaken in time to include in the amendments. Stormwater infrastructure will be provided by developers as on-site non-trunk infrastructure.

- Public consultation of LGIP Amendment - commencing on 6 June 2025 and closing on 4 July 2025 (1 month).
