Personal Appearance Services

To make an application for higher risk personal appearance service with Council, you must submit a fully completed form with supporting documentation and the relevant fee.

Supporting documentation includes the items listed in the Related Information below.

Ensure the applicant is the legal entity, either a person or company, (a business or trading name is not a legal entity and cannot be a licence holder).

Renovating, refurbishing or moving an existing premises may require an application for amendment. Complete and submit the below form along with the fee.

If you are taking over a business from an existing operator, you will need to determine whether the business holds a current licence and the current status of the premises. It is a requirement that the existing operator notify the buyer of the need to hold a licence certificate.

In the event that the licence is to be transferred or the business is sold, a transfer form(PDF, 478KB) is to be completed and submitted to Council with the relevant fee. In addition to the standard details on the transfer form, the details and signatures of the new operator and the existing operator will be required.

It is also recommended that you conduct a business search to determine if there are any outstanding requisitions or outstanding fees owed by the business, a public health search can be completed using the property search form via Council's Online Services portal. There are three types of searches as follows:

• Activity Facility Records Search - Current status of licence/registration records only (does not include an inspection report).
• Single Activity/Facility Search and Inspection - Current status of licence/registration records and current inspection report where applicable. Applications must be accompanied by the relevant fee and consent of the licence/registration holder.
• Multiple Activity/Facility Search and Inspection - Current status of licence/registration records and current inspection report where applicable for multiple activities at the one premise (e.g. an ERA and DGSM at the one premise). Applications must be accompanied by the relevant fee and consent of the licence/registration holder.

You and your staff are responsible for complying with all requirements of the relevant legislation. This includes:

• Following the Queensland Health Legislation
• Holding a licence – higher risk personal appearance services only
• For higher risk personal appearance services, premises fit-out must meet the Queensland Development Code Part 5.2 - Higher Risk Personal Appearances Services. Queensland Development Code MP5.▸ Listen
• All higher risk personal appearance services operators must hold an infection control qualification ‘HLTINF005 – Maintain infection prevention for skin penetration treatments’ (or HTLIN2A, HLTIN402B, HLTIN402C)

In addition to personal appearance services legislation, businesses must comply with all other relevant requirements including:

• Tattoo operator licence – Queensland Government Office of Fair Trading
• Laser licence – Queensland Health
• Medicines (for example, botulinum toxin, dermal fillers) – Queensland Health
• Therapeutic goods including devices (for example, microneedles and microneedling handpieces), blood and blood components (for example, platelet-rich plasma), disinfectants and antiseptics – Therapeutic Goods Administration (TGA)
• Health practitioners – Australian Health Practitioner Regulation Agency (AHPRA)
• Industrial chemicals including in personal care, skincare, makeup and other cosmetic products, and tattoo inks and permanent makeup – Australian Industrial Chemicals Introduction Scheme (AICIS)

Use one of the options below to apply for a higher risk personal appearance services licence for a:

• fixed premises;
• mobile premises; or
• temporary premises.

Before you apply

We recommend you contact us for advice on whether you will need development approval. Make sure your site has the appropriate approval before submitting your application.

Depending on the type, size and intended use of any permanent buildings and structures, building approval and certification from a building certifier may also be required.

Gather your documents

You will need to attach the following supporting information to your application:

• floor plan to scale detailing location, materials and dimensions of work area zones, equipment and fittings (including hand washing facilities and sinks)
• cross-section drawings to scale detailing location, materials and dimensions of work area zones, equipment and fittings
• site plan detailing location of premises in regard to other premises and facilities
• sterilising and cleaning equipment details, e.g:
  - skin penetration equipment/instruments used and the method of cleaning, disinfection and/or sterilisation; or if equipment/instruments are single-use disposable
  - details and location of any reprocessing equipment for reusable instruments (e.g. autoclave, ultrasonic cleaner, washer-disinfector), including validation certificate per AS5369 if applicable
  - washing machine for cleaning reusable linen, or specify if linen is washed by a commercial laundry, or if single-use disposable linen is used
• waste disposal equipment (e.g. general waste, sharps containers, and clinical waste if applicable)
• statement of attainment for infection control competency standard for each person providing higher risk personal appearance services (HLTINF005, HLTIN2A, HLTIN402B or HLTIN402C)
